AirBnB leasing results in termination of co-op tenancy
In 436-438 West 47th Apartment Owners Inc. v. Dawes, et al., tried by partner Scot Mackoff, the residential cooperative corporation was granted judgment of possession and a warrant of eviction.
The coop shareholders sublet their apartment through AirBnB, even after being warned by the Board to cease such activity. The action proceeded under a claim of objectionable conduct and not merely illegal leasing, so there was no cure available to the shareholders.
